TERMS AND CONDITIONS - Zodiac Online Shop
These are our terms and conditions. Together with the references they contain, they apply to every agreement that we, Marine Trading International BV trading as Zodiac Nederland (Chamber of Commerce no.: 34289630), enter into with you via this WEBSHOP. You can also reach us by telephone on +31-(0)297-368385. We reserve the right to amend these terms and conditions. You agree that the latest version of these terms and conditions will always apply to our agreement.
Article 1 - Products
We sell watersports items such as inflatable boats, outboard motors, parts and accessories.
Article 2 - Payments
The (total) price of the products, including taxes and shipping costs, is shown in our webshop before you accept the offer. Payment is made in advance via our secure online payment service. We accept, among others iDEAL, PayPal, Klarna, MobilePay, Shop Pay, Apple Pay, Google Pay, Visa, Mastercard. Online payments are processed securely via our payment partners Mollie, Shopify Payments and Paypal.
You can also pay for your order by standard bank transfer in advance of shipment.
If a price change occurs after acceptance of the offer, you will be informed and you can then decide to withdraw from the purchase.
Shipping costs are at your expense. Within the Netherlands, we do not charge shipping costs for orders from 50 euros.
Product prices include VAT.
Article 3 - Deliveries
We deliver your product to the address you provided when placing the order. You can no longer change the address once we have shipped the parcel. DHL, PostNL or another courier service handles distribution. Once the parcel has been shipped, you will receive a track & trace code from us, allowing you to follow the order. You are obliged to accept delivery of the parcel at the time it is delivered to you. The risk of damage and/or loss of products remains with us until the moment of delivery to you, unless expressly agreed otherwise. We do our best to deliver the order as quickly as possible. If the order is delayed, we will inform you of this in writing. We guarantee that you will receive the order no later than 30 days after order confirmation. If this unexpectedly does not succeed, you can request that we (a) immediately refund the amount you paid for the product, or (b) send a replacement product (of equal value).
Delivery times are indicative and exceeding them does not entitle you to compensation.
Article 4 - Warranties
We guarantee that the goods sold conform to the agreement, that they will function without defects and that they are suitable for the use the buyer intends to make of them. The warranty period follows the warranty terms of our suppliers and may differ per product. If you have any questions about this, you can email us at info@zodiaconlineshop.nl.
Article 5 - Returns - Right of withdrawal
You have 14 days to withdraw the order and register the return. You can do this as described on our returns page. After you have received confirmation from us, you must send the product within 14 days. We will refund the full purchase amount within 14 days after the return has been registered, provided we have already received the product back in good order.
Once we have received the product, we will refund the full purchase amount within 14 days, or in the case of an incorrect product we will replace it with the correct product. The costs for the return shipment are at your expense. During the period in which you can decide whether you wish to keep the product, you must handle the product and packaging with care.
You may only unpack and use the product to the extent necessary to determine whether you wish to keep it. If the product is damaged or the packaging is more damaged than necessary to try the product, we may charge you for this reduction in value. Therefore, handle the product with care and ensure it is properly packed when returning it. A product with signs of use cannot be returned. Second-chance, second-hand and other non-new items cannot be returned as standard, unless stated otherwise in the product description.

Article 6 - Liability
We are not liable for damage caused by use of a product. This does not apply if such damage is caused by our intent, gross negligence or wilful recklessness. In any event, your right to compensation will be limited to a maximum of the amount of the ordered and paid product.
Article 7 - Intellectual property rights
All intellectual property rights (such as: copyrights, figurative marks, word marks) to our texts, photos, images and other materials are our property (or are managed by us with the permission of the rights holder). Your use must not infringe these rights.
Article 8 - Complaints procedure
If you have a complaint about the performance of the agreement, we would like to hear from you. Send your complaint in full and clearly described within 2 months after you have identified the defects to info@zodiaconlineshop.nl. We will handle your complaint as soon as possible, no later than 10 days after we have received it. If it takes longer to resolve the complaint, you will receive confirmation of your complaint within two days and we will let you know when we expect a substantive response.
If your customer is found to be justified by us, we will repair or replace the delivered products. If we cannot resolve the complaint between ourselves, a dispute arises that falls under the disputes procedure.
You have the option, after first reporting the complaint to us, to submit your complaint via the European ODR platform (http://ec.europa.eu/odr).
Article 9 - Disputes procedure
Dutch law applies to these terms and conditions and to the agreements we enter into with you. In the event of a dispute, the court in Amsterdam has jurisdiction.
In the event of complaints, a consumer must first contact the entrepreneur. If the webshop is affiliated with WebwinkelKeur and in the event of complaints that cannot be resolved by mutual agreement, the consumer must contact WebwinkelKeur (www.webwinkelkeur.nl), which will mediate free of charge. Check whether this webshop has an active membership via https://www.webwinkelkeur.nl/leden/. If no solution is reached, the consumer has the option to have the complaint handled by the independent disputes committee appointed by WebwinkelKeur; its decision is binding and both the entrepreneur and the consumer agree to this binding decision. Submitting a dispute to this disputes committee involves costs, which must be paid by the consumer to the committee in question.
